Hong Kong named top financial center for second year

LONDON (Reuters) - Hong Kong was named the world's top financial center for the second year running by the World Economic Forum (WEF), thanks to the strength of its business environment, infrastructure and a favorable tax regime.

The WEF's annual Financial Development Report considered a wide range of factors and underscored the rise of Asian trading centers and the influence of China as the world's second-largest economy.

Rival surveys based purely on the total value of transactions typically put New York or London in top place.

However, stalling capital markets, sputtering economic growth and waning trust in financial organizations served to ensure that the top six positions remained unchanged from 2011, the WEF said.

"Macroeconomic uncertainty as well as concerns related to regulation, contributes to inhibiting the financial industry from funding much-needed growth," said Giancarlo Bruno, senior director at the WEF, which hosts an annual meeting of political and business leaders in Davos, Switzerland.

Though the report noted "pockets of improvement" across some banking-related indicators, it said that these signified "only a small step in what will be a long road to recovery".

The United States, Britain, Singapore, Australia and Canada followed Hong Kong in the 2012 rankings.

The report looked at legal and regulatory factors, business environment, financial stability, banking and non-banking services, markets and access to them.

"Despite these strengths, Hong Kong has a relatively underdeveloped bond market and its financial sector has yet to be fully liberalized," the report said.

Japan, Switzerland, the Netherlands and Sweden made up the remainder of the top 10 financial centers.

The report said that policymakers face a "monumental" task to restore confidence in markets as waning trust in the overall system holds back investment.

Heat to raise banner, then host Celtics in opener

MIAMI (AP) ? The last time the Boston Celtics played a game that truly counted, they had to endure a Miami Heat celebration.

New season, same deal.

Only this time, the party will come before tip-off ? not after the final horn.

LeBron James gets his long-awaited first championship ring Tuesday night, when the Heat pay homage to last season's NBA title with a pregame banner-raising ceremony. Dwyane Wade will get his second ring, Heat President Pat Riley his eighth, and the party is the prequel to a Celtics-Heat rematch of last season's Eastern Conference finals that went seven games before Miami advanced.

"We'll honor and respect what we were able to accomplish before the game," Heat coach Erik Spoelstra said.

There's another major story line, of course. It's the first time the Celtics will face Ray Allen as an opponent since he left Boston over the summer and signed with Miami, a decision that his former coach and teammates were most unhappy about.

"It's just another basketball game," Celtics guard Rajon Rondo said.

No, it isn't.

Even Celtics coach Doc Rivers acknowledges that much. After all, it's Boston-Miami.

"If we win, do we get a trophy? We get one win and that's it," Rivers said. "And if we lose, which we don't want to do, we get one loss and it doesn't mean we still can't win it. But at the end of the day, we're all human. ... These games, they don't really have more meaning, but they do have more meaning."

It's the first marquee game of the season, but not actually the first game of the season. That distinction goes to the Washington-Cleveland matchup, which starts on the Cavaliers' home floor about an hour before Heat-Celtics.

The NBA's three-game opening slate concludes in Los Angeles, where the revamped Lakers ? now with Steve Nash and Dwight Howard to play alongside Kobe Bryant ? play host to the Dallas Mavericks.

In Miami, there have been a slew of upgrades at the arena over the summer ? slightly different looks here and there, a new nightclub and restaurant, more concessions and bars for ticketholders to enjoy. The Heat will even offer fans the chance to purchase championship-ring-related merchandise, designed in the same manner as the players' title-reward jewelry.

The upgrades extend to what's going to be on the court as well.

Miami kept its championship rotation intact, while adding Allen and Rashard Lewis to the mix. Allen knows it will be unusual to see the Heat get their rings, especially since five months ago, he was busy trying to thwart their title march.

"I'm excited for these guys, having spent time around them over the last two, three months, getting to know them and their families," Allen said. "I'm happy for them that they won, but at the same time, they beat me and put us out. I understand the emotions that Boston will feel, watching the whole ceremony. But at the same time I'm excited for these guys. And once it's over with, it's business as usual."

Boston's roster looks improved, even without Allen. Jason Terry was signed to bolster the Celtics' bench, there's an influx of youth in the rotation, Jeff Green is back after heart surgery, and the remaining members of what was a Big Four ? Rondo, Paul Pierce and Kevin Garnett ? are loaded up for another championship push.

Still, the rivalry and the Allen reunion, make no mistake, weigh heavily on both sides. Neither Garnett nor Pierce has spoken to their former shooting guard since he signed in Miami.

"We're not going to make this into a Ray Allen or Paul Pierce, Kevin Garnett, Rondo thing," Pierce said. "Right now my focus is on playing in the game tomorrow versus the Miami Heat. Everything's that happened has already happened. He's here. He's happy to be here. We wish him the best for his family and the situation, but I'm more focused on the Boston Celtics."

It's the second ring-night in Heat history.

It's almost certain to go better than the first one after Miami's 2006 title.

Any mention of the score from that Chicago-Miami opener ? 108-66 ? still makes Dwyane Wade and Udonis Haslem cringe. They're the last two players remaining in Miami from that Heat team, which endured the worst opening-night loss ever for a reigning champion.

"I just remember we got beat," Wade said. "I don't remember the game. That's how long ago that was. Different time."

Haslem remembers plenty.

"It sticks," Haslem said. "But it's six years later. You learn and you move on and you try not to let it happen again. We've got a different group of guys. We're smarter, me and Dwyane are. And we understand the challenges of defending the title now. We were naive. At that point, we thought we could do it again the next year and just do it again and do it again and do it again."

Well, actually, that is James' goal.

He didn't come to Miami for one title. He came for multiple ones. That's one of many reasons why even he's downplaying the ring ceremony and placing his focus squarely on another marquee matchup with Boston.

That being said, he's not overstating it, either.

"Game one doesn't determine who's the better team," James said. "I mean, it's game one."

(AP) ? The New York Stock Exchange will open on Wednesday ? because it had to open.

In a bit of welcome news for fund managers, investors and even the economy, the company that operates the iconic exchange at 11 Wall Street announced it would not extend its trading shutdown to a third day.

Wall Street experts had feared that another delay because of Hurricane Sandy would have meant a dangerous back-up of customer orders to buy and sell stock. It also could have dealt a blow to the image of U.S. markets, already damaged by investor distrust, sudden market swings and a series of trading glitches, including the botched IPO of Facebook.

"The world is used to seeing the financial markets through the lens of the floor of New York Stock Exchange," said Larry Leibowtiz, chief operating officer of NYSE Euronext, which operates the exchange. "It gives them a sense of comfort."

The New York Stock Exchange said its building and trading floor are fully operational and that normal trading will resume Wednesday at the usual starting time of 9:30 a.m. Since power is out in much of downtown Manhattan, the company said it will run the exchange using its own backup generators, a first.

The closing on Tuesday marked the first time since 1888 that the NYSE halted trading for two consecutive days because of weather. As the NYSE staff scrambled Tuesday to make sure that that 124-year record wouldn't be surpassed by another day of delay, there were reports on the Internet that the exchange floor had flooded.

It was a false alarm.

The exchange also said that a key data center in New Jersey housing computers used to trade stocks was in good condition after the storm and would be fully up and running Wednesday.

Mark Travis, president of Intrepid Capital Funds in Jacksonville Beach, Fla., said he was worried that the longer markets remained closed, the greater the backlog of pending trades that would need to be cleared when normal trading resumed.

"You build up pressure when you keep people out of the markets," Travis said. "Trading volume that may normally happen in a two-day period could get compressed into an hour or two when markets reopen."

Add to that Hurricane Sandy's timing, which was awful for the exchange. Instead of arriving on a weekend when the exchange is closed, it blasted into Manhattan on a Monday, and the start of a crucial week, too.

This week is the last full one before the presidential election. What's more, the government publishes a key report Friday that traders like to bet ahead of ? October's unemployment figures.

Another wrinkle: Wednesday is the last day of the month, which is when traders and fund managers look to stock markets for final prices to value holdings for reports they're required to send to investors and regulators.

"They need to have current prices for their holdings," said Peter Jankovskis, co-chief investment officer at Oakbrook Investments in Chicago. "It's a positive that they are reopening the market."

Jim Paulsen, chief strategist at Wells Capital Management, agreed, but for a different reason ? the economy.

"It's not just about trading; it's about confidence," Paulsen said. "We're watching these horrific images of the storm, and people are thinking whether they should go ahead with that big purchase they were thinking about. It doesn't do any good to have another day with headlines saying the U.S can't figure out how to open its stock exchange."

The exchange spent much of Tuesday testing its trading systems using its all-electronic Arca system. But Leibowitz, the chief operating officer, said there would be enough traders and market makers on the floor of the exchange tomorrow ? 100 or so, he estimated. He said many are staying in nearby hotels.

The exchange also tested to see whether fuel trucks could get to the exchange despite flooded highways, tunnels and bridges. Leibowitz said the trucks were able to arrive, and the exchange took the opportunity to top off the tanks for the backup generators. The exchange can operate for 40 hours on backup generators before refueling.

"It's not like your car," he said. "You don't wait until fuel light goes on."

Thomas Caldwell, chairman of Caldwell Securities, said he was concerned there would be a big news event that would change investors' opinions about stocks during the shutdown. That could have led to a flood of orders to buy or sell stock when the market reopened. Luckily, that didn't happen.

"Europe is still Europe, Japan is still Japan," he said.

In addition to the halted trading, dozens of companies postponed earnings reports this week because of the storm.

In Europe, though, business went on as usual Tuesday. Stock markets rose broadly after falling the day before. Trading was subdued in the wake of the storm. Britain's FTSE 100 index rose 0.9 percent, Germany's DAX rose 1.1 percent and the CAC-40 in France was 1.5 percent higher.

Crude oil rose 14 cents to settle at $85.68 in electronic trading on the New York Mercantile Exchange.

U.S. bond trading was closed Tuesday. It will resume Wednesday.

Berlin authorities say they shot and killed a 120 kilogram (265-pound) wild?boar?after it attacked and injured four people including a police officer in a residential neighborhood.

Police said Tuesday the?boar?bit a 74-year-old man on the back and leg, and knocked a 74-year-old woman to the ground and injured her hip on Monday afternoon in the Charlottenburg area of the capital. It also bit a 24-year-old woman before she climbed aboard a parked car to safety. All three were treated in a hospital.

Police say when a police officer arrived, the wild boar?attacked him and cut his leg before he pulled his gun and killed the animal with "multiple shots."

Wild?boars?are relatively common in green Berlin, though rarely cause problems beyond digging up gardens.

Verizon to sell Nokia phone

NEW YORK (AP) ? Verizon Wireless, the largest cellphone carrier in the U.S., on Monday said that it will sell a Nokia phone for the first time in years, lending support to the embattled Finnish company's turnaround effort.

Verizon says it will sell the Lumia 822, an exclusive model that's part of Nokia's lineup of smartphones based on Microsoft's Windows software, for $100 with a two-year contract. It will be in stores by Thanksgiving.

Verizon rivals AT&T and T-Mobile USA started selling Lumia phones earlier this year, and will join Verizon in launching new phones with Windows Phone 8, an updated operating system. Microsoft held a launch event for Windows Phone 8 in San Francisco on Monday, but the first phones are some weeks away from U.S. store shelves.

Even though it was, until recently, the world's largest maker of phones, Nokia has been largely absent from the U.S. market for many years. Its early smartphones never caught on in the country, and it was virtually shut out once the iPhone launched in 2007.

In addition to Nokia, Verizon will be selling Windows Phones from Samsung Electronics and HTC.

In Vietnam, US relies on pirate site to network

HO CHI MINH CITY, Vietnam (AP) ? It's a wildly popular website laden with unlicensed songs and Hollywood movies, a prime exhibit of the digital piracy that is strangling the music industry in Asia and eroding legitimate online sales around the world.

But a few clicks inside the free-to-download bonanza that has pushed Vietnam's Zing.vn into the globe's top 550 websites reveals a surprising presence: the American government, which maintains a bustling social media account on the site.

Washington is a vocal proponent of intellectual property rights in Vietnam as it is around the world, and a site like Zing would be shut down in the United States. But with space with for public diplomacy limited in Communist Vietnam, the embassy's uses its "Zingme" account to reach out to young people in Vietnam as it seeks to build closer ties with its former enemy.

The embassy presence shows just how mainstream pirate sites have become in Vietnam, where the government does nothing to stop them operating. But it also raises questions whether Washington is legitimizing a renowned pirate site that record labels, singers and industry groups say ignores requests that it take down infringing material.

Those have become pressing since Coca-Cola and Samsung pulled their advertising from the site earlier this month because of piracy concerns following questions by The Associated Press. The move challenged Zing's business model and was praised by recording industry groups. Samsung said last week it was also closing its Zingme account for the same reason.

The embassy said it recognized the concerns for U.S. copyright interests posed by Zing but that it believed that "contact with users of this website" could reduce traffic or infringing activity on it. The mission sometimes uses its Zingme page to post about copyright infringement.

Its statement noted that the site had removed, at its request, the link to infringing material that appears on other Zingme pages as a matter of course. It also noted to its lack of options in a country where the Communist government controls the media, saying "there were few spaces for public discourse and intermittent access to Facebook", referring to a block the government sometimes puts on the American social networking site.

But not everyone thinks engaging with Zing is the right thing to do.

"Here we are as an American company trying to set things right with one of the biggest pirates in Vietnam but the U.S. embassy is essentially showing its support by being on its site," said Mimi Nguyen, an American who has been trying fruitlessly to get Zing to take down some 10,000 songs owned by her family's business for a year.

"It is really sad to find out the embassy is using their platform."

The Recording Industry Association of America, which praised the decision by Samsung and Coke to withdrawn from Zing and has labeled Zing a "notorious" pirate site, said it was neither endorsing nor criticizing the embassy's decision to maintain the site.

Neil Turkewitz, a senior vice president at the association, said he imagined the embassy had tried to balance the ability to target a tech-savvy demographic with anti-piracy messages against the appearance of a connection between it and the site.

"My guess is that it wasn't an easy decision," he said.

The recording industry around the world is struggling to make money from online distribution models, and illegal downloading remains rampant. Artists and producers in much of Asia are feeling the pinch especially hard because governments have failed to pass or enforce anti-piracy laws. Licensed CDs, films and downloads can cost the equivalent of a day's salary, making it even harder to wean people off pirated products.

In Vietnam, inaction by a government that sees no political upside in cracking down on what many see as a victimless crimes has pushed the industry to the point of collapse. Zing is seen as the No.1 enemy by those who speak out against its effective stranglehold over the country's music industry.

"Zing is destroying the industry and they know it," said record producer Quoc Trung, who is leading a campaign against online piracy. "We need people to pay for music, not just click on it. It is now or never."

Zing, which declined repeated requests for comment on this article and a previous one, has used free download to become the sixth-most visited site in Vietnam, and the second most popular Vietnamese music download site. Around 15 percent of its visitors are from overseas. It is not the only infringing website in Vietnam by far, but it is the most visited.

Sites that offer pirated content alongside other internet services like Zing exist elsewhere around the world and are among the most reprehensible, according to the Recording Industry Association of America.

"They want to appear as legitimate actors, and have functions unrelated to piracy, yet operate network services that include features that intentionally and effectively induce infringement," it said in a letter to the U.S. Trade Representative in August asking the government to use all the tools at its disposal to ensure Zing and others are not permitted to undermine legitimate online markets.

"These services deliberately gain market share by providing access to infringing materials, launching music services without any form of licensing, and have demonstrated continued resolve to engage in conduct based upon misappropriation."

Zingme closely resembles Facebook, which recently overtook the Vietnamese site in subscriber numbers, according to one research group. Facebook is sometimes blocked by the government because of fears it could be used to mobilize dissent against its one-party rule. Zingme is never blocked, and is more popular with younger, less educated Vietnamese. Companies and institutions often have accounts on both. The embassy has more than 18,000 friends on Zingme, compared to 12,000 on Facebook.

Many in the industry have no choice but to work with Zing even as it distributes their music and films for free. Not having your music on the site means getting an audience for live concerts, or attracting commercial sponsorship, is almost impossible, industry executives said. But a few are pushing back, among them established singer Le Quyen, who is suing Zing and eight other infringing websites.

"I'm sure that Zing is aware that what they do is wrong, but they are afraid that other singers will put pressure on them if I win the case," she said before one of her near-weekly concerts at a venue owned by her husband here. "That's why they keep avoiding my demands. Their tactic is to drag the case on until their opponent gets tired and gives up."

Some in the industry predict Zing and other websites will embrace a more legitimate model, rather like Baidu in neighboring China, which after years of complaints from international and local record labels about pirated content signed a licensing deal with its former critics last year. Major Western record labels eager to sell music in the 13th most populous country in the world have been in early talks with Zing and other sites, but there is no deal on the horizon.

For now, the sites are not taking down their unlicensed content because doing so would mean that users would flock to that of a rival, and new ones are cropping all the time. Those offering unlimited downloads of Hollywood movies for a monthly subscription as low as $2 are amassing large audiences, and could be looking to leveraging their popularity to become legitimate providers.

"In Vietnam, you build an audience first, and then you negotiate," said Phung Tien Cong, a manager at MVCorp, which is trying to establish a pay-for-song business in collaboration with Zing, other websites and license holders.

Reclaiming Happy Hour, Toddler and All | Science of Mom

When Cee was an infant, I remember lamenting to a friend about how difficult the evening hours could be. Cee was often fussy. Husband was usually returning home from work hoping for some quality time with her, but instead she would cling to me. ?Meanwhile, I had some crazy idea about getting a balanced meal on the table. Sometimes, I wanted nothing more than to be alone in the kitchen with both hands free. With a demanding baby, dinner usually ended up only being accomplished when Husband stepped in to finish what I had started and to clean up the mess left in my wake.

My friend empathized. She told me that she had deemed this time of day between about 5 and 7 PM, ?Unhappy Hour.?

It is a fitting name, I think. Pre-kids, we would have been meeting friends for drinks and appetizers after work. Or maybe Husband and I would be cooking dinner together, glasses of wine in hand, telling each other about our days. It was often my time to go for a run or to a yoga class or to take my dog for a long walk. Regardless, happy hour used to be that time of day when we could reconnect with our friends and family, unwind from the day?s work, and recenter ourselves.

Reconnect. Unwind. Recenter. Is that even remotely possible with a toddler awake in the house?

These days, Unhappy Hour is daycare pick-up, sometimes errands, and dinner preparation, all within about an hour in order to stay on track for an on-time bedtime. Cee seems to fall apart at the least discomfort or injustice, and my efforts to console her can completely throw off my dinner preps. If both Husband and I are home, we can tag-team this ? one of us hanging out with Cee and the other taking the lead on dinner. Sometimes Cee seems to need one or the other of us more, just as she did as an infant, and we make adjustments as needed. Things are tougher though if one of us is working late, and given Husband?s weird work hours, this happens a lot.

I?ve been reading Ellyn Satter?s Secrets of Feeding a Happy Family. It is required reading for one of the courses I?m teaching this fall, and I highly recommend it. It is really a comprehensive guide to feeding ? from attitudes about feeding and eating, to meal planning, to cooking itself. Satter even addresses Unhappy Hour, which she calls ?Bewitching Hour.? That she included this is brilliant. You can preach all you want about the value of the family meal and balanced nutrition, but if you can?t get past Unhappy Hour, you?ll get discouraged fast. That?s when the fast food drive-through suddenly seems like a great idea.

Satter says (and I wholeheartedly agree) that the difficulty with Unhappy Hour is that there are several priorities trying to squeeze into a short amount of time. Obviously, we?re trying to get dinner on the table. But we also need to reconnect with our kids. If we?ve been apart for most of the day, they need us, and in a quality kind of way. And finally, we need a small time and space for ourselves ? to unwind and recenter.

Reconnect. Unwind. Recenter. And cook dinner.? Sounds familiar, right? But this is SO much harder when a tired toddler is involved.

Since going back to work, I?m still trying to figure out how to juggle these multiple priorities in the short span of Unhappy Hour. Here?s one thing I?ve learned: they don?t have to be competing priorities. They?re intertwined, and they?re all important. When I recenter myself, it?s easier to reconnect with Cee. When I reconnect with Cee, dinner prep is suddenly less daunting.

I have been making a real effort to give Cee 10-15 minutes of my time when we get home from daycare. That?s hard to do when I look at the clock and just want to get dinner started. But I?ve learned that not only does it feel good to reconnect, it also makes dinner prep go more smoothly. After a little time with me, Cee is often happy to play independently or maybe cheerfully ?help? with dinner prep. If I try to skip reconnect time, she?s hanging on my leg, grabbing at the knives, or insisting on being held.

Satter has great advice about the reconnecting piece:

?Here is a secret about playing with your child: With playing, as with eating, children like to take the lead and want you to be a supportive presence. You don?t have to pile up blocks for him to knock down or make elaborate houses or teach about the laws of shapes and sizes and proportions. All you have to do it be there, pay attention, ask about what your child is doing, and make little comments like, ?That?s a big wall.? You can even do all of this in a prone position, as long as you truly pay attention and take an interest.?

(Prone position: I like that idea.)

Making a little time to unwind and recenter myself is harder. I?ve learned to relish the 8 minutes alone in the car as I drive to pick Cee up from daycare. If I can, I fix myself a cup of tea for the road, and I grab an apple or handful of almonds or a cookie on the way out the door. In the car, I turn off the news and listen to classical music. Sometimes I record a little audio diary on my phone just to dump out some thoughts. I?m making an effort to arrive at daycare in at least a near-centered state. Maybe in a year or two, Cee and I can talk about giving Mama time to put her feet up when we get home. Right now, that doesn?t seem realistic. Not during Unhappy Hour.

I?m trying to reclaim Happy Hour, in some small way, toddler and all. Reconnect. Unwind. Recenter.

(AP) ? Storm Troopers, cyborgs, superheroes and other comic-book fans can count on their annual pilgrimage to San Diego for another four years.

San Diego Mayor Jerry Sanders announced Monday that Comic-Con has extended its contract with the city through 2016. It had been set to expire in 2015.

The pop-culture convention draws 130,000 visitors from around the world and contributes more than $180 million to the city's economy, Sanders said.

Comic-Con began in San Diego in 1970 but has become so popular over the past four decades that it has outgrown the San Diego Convention Center.

Comic-Con spokesman David Glanzer said city officials and local businesses have helped the event remain in San Diego by allowing organizers to expand beyond the convention center to create a "Comic-Con campus" using meeting space in nearby hotels.

"We were born in San Diego, so our hope is to stay here," Glanzer said. "But first and foremost, we have to look at the ability to put on a successful show and meet the needs of the people who attend the show."

A spokesman for the mayor's office said plans are moving forward to expand the San Diego Convention Center, and city officials hope to break ground on the project next year.

High court hears closely watched copyright case

(AP) ? Costco, eBay, Google and the nation's top art museums are backing a Thai graduate student against book publishers, the movie and music industries and other manufacturers in a Supreme Court battle over copyright protections with important implications for consumers and multibillion dollar annual sales online and in discount stores.

Supap Kirtsaeng was studying in the United States when he struck a nerve in the publishing world by tapping into the market for cheaper college textbooks. Kirtsaeng re-sold copyrighted books that relatives first bought abroad.

His profitable venture provoked a copyright infringement lawsuit from publisher John Wiley & Sons. The case is being argued Monday at the high court.

Kirtsaeng used eBay to sell $900,000 worth of books published abroad by Wiley and others and made about $100,000 in profit. The international editions of the textbooks were essentially the same as the more costly American editions. A jury in New York awarded Wiley $600,000 after deciding Kirtsaeng sold copies of eight Wiley textbooks without permission.

The issue at the Supreme Court concerns what protection the holder of a copyright has after a product made outside the United States is sold for the first time. In this case, the issue is whether U.S. copyright protection applies to items that are made abroad, purchased abroad and then resold in the U.S. without the permission of the manufacturer. The high court split 4-4 when it tried to answer that question in a case in 2010 involving Costco and Swiss watch maker Omega.

Justice Elena Kagan sat out the Costco case, but will join the other justices in hearing the new dispute. She signed the government's legal brief in the Costco case that took Omega's side. The government is backing the publisher against Kirtsaeng.

The court already has rejected copyright claims over U.S.-made items that were sold abroad and then brought back to the United States for re-sale.

The current case has attracted so much attention because it could affect many goods sold on eBay, Google and other Internet sites, and at Costco and other discount stores. The re-sale of merchandise that originates overseas often is called the gray market, and it has an annual value in the tens of billions of dollars.

Consumers benefit from this market because manufacturers commonly price items more cheaply abroad than in the United States.

The federal appeals court in New York sided with Wiley in this case.

EBay and Google say in court papers that the appellate ruling "threatens the increasingly important e-commerce sector of the economy." Art museums fear that the ruling, if allowed to stand, would jeopardize their ability to exhibit art created outside the United States.

Conversely, the producers of copyrighted movies, music and other goods say that their businesses will be undercut by unauthorized sales if the court blesses Kirtsaeng's actions.

Kirtsaeng says the example of textbooks illustrates the larger point of how manufacturers already drive up prices for U.S. customers. "Textbook publishers have long exploited their captive customers," E. Joshua Rosenkranz, Kirtsaeng's lawyer, said in court papers. Citing government statistics, Rosenkranz said the price of textbooks has tripled over the past 20 years, rising much more quickly than the pace of inflation.

In response, Wiley argues that the other side's "parade of horribles" is speculative and unpersuasive. Current copyright law in place since 1976 has not resulted in any threats to museums or other institutions that house or display foreign-made works, lawyer Theodore Olson said on behalf of Wiley.

And Olson said there may be good reasons why manufacturers price the same goods differently for domestic and foreign sales, including lower incomes and standards of living in many foreign countries.

The case is Kirtsaeng v. John Wiley & Sons, 11-697.
