?Abstract? There are few scholars studying deeply about the laborers dispatched in China. On the view from the protection of the right of the overseas laborers, this article paid more attention on the problems about the Chinese dispatched laborers in Japan and discussed the issues about the protection about these people.There are five parts in this article:The first chapter is about the legal system of the overseas laborers dispatched in China and the trainees in Japan. This article tries to describe the development of the labor dispatched in China, the realistic about the labor dispatched from China to Japan and the laws related to the oversea laborers dispatched in China and the trainees in Japan.The second chapter is about illegal acts from the accepted company in Japan and the dispatched company in Chinese during the proceeding of the labor dispatched business from China to Japan. This article analyses the reasons about these problems and points out the defects of the legal system of protection for the laborers dispatched both in China and in Japan.The third part analyses the legal relationship about the objects of the labor dispatched service from China to Japan. This article mainly explains that there is the labor relationship between the dispatched company in China and the labor and nature of the contract is the labor contract. The overseas labor businesses reveal three main labor objects, expatriates and foreign laborers to receive the rights and obligations between enterprises with foreign elements. So when the rights and the interests of the laborers dispatched violated, they could take suits in Chinese court to protect their rights according to the Chinese law.The fourth part analyses whether laborers dispatched from China to Japan advocate their labor rights from Chinese Judiciary, they may be faced the legal dilemma because of the inadequate of nowadays Chinese justice system. In this case, we need to think about the outlets of how to protect the labor rights of labor dispatched to Japan.The fifth part is about the countermeasures of how to protect labor rights of laborers dispatched from China to Japan. The author puts forward the suggestions and views from aspects of improving the relevant legal rules, strengthening the administration, making foreign institutions in Japan to play active role and so on.
